By creating an account on Mockist ("the Platform"), accessible at www.mockist.net, you ("User") agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, and all applicable laws and regulations. If you do not agree to these Terms, you must not use the Platform.
Mockist provides an online exam preparation platform that generates practice tests using artificial intelligence for educational purposes. The Platform offers:
3.1. You must be at least 13 years of age (or the minimum age of digital consent in your jurisdiction) to create an account. Users under 18 must have parental or guardian consent.
3.2. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
3.3. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate.
4.1. Free Tier: Users may access the Platform for free with up to 3 practice tests per day. The Free Tier requires Users to share a promotional post on social media once per calendar month to maintain access. Failure to complete the monthly share will temporarily suspend test generation until the share requirement is fulfilled.
4.2. Premium Plans: Premium subscribers receive enhanced access with up to 15 tests per day, no advertisements, and priority support. Premium plans are billed at the rates displayed on the Platform at the time of purchase.
4.3. Lock-In Quarterly Plan: Users who subscribe to the Lock-In Quarterly plan at the promotional rate may renew at the same rate for subsequent quarters, subject to the plan remaining available on the Platform.
4.4. Daily Limits: To ensure fair usage and platform stability, all plans are subject to daily test limits: Free Tier (3 tests/day), Premium (15 tests/day). These limits reset at midnight UTC daily.
4.5. All payments are processed securely through Paystack. Mockist does not store credit/debit card details.
5.1. To maintain Free Tier access, Users must share a Mockist promotional message on at least one supported social media platform (X/Twitter, Facebook, Instagram, or TikTok) once per calendar month.
5.2. Promotional messages are provided by the Platform and may not be altered in a way that misrepresents Mockist or its services.
5.3. Mockist reserves the right to verify shares and may suspend Free Tier access if sharing obligations are not met or are found to be fraudulent.
5.4. The sharing requirement may be waived at Mockist's sole discretion or by upgrading to a Premium plan.
6.1. Free Tier users will see advertisements served through Google AdSense. Ads are displayed in non-disruptive placements.
6.2. Premium subscribers will not see any advertisements on the Platform.
6.3. Mockist is not responsible for the content of third-party advertisements.
7.1. All practice questions, explanations, analytics data, and Platform content are generated or curated by Mockist and are protected by copyright and intellectual property laws.
7.2. Users may not reproduce, distribute, modify, or commercially exploit any Platform content without explicit written permission from Mockist.
7.3. Practice tests are generated by artificial intelligence for educational purposes only. Mockist does not guarantee that questions will appear on any actual examination.
Users agree not to:
9.1. Premium subscriptions may be cancelled at any time. Access continues until the end of the paid billing period.
9.2. Refunds are available within 7 days of purchase if fewer than 5 tests have been generated during the subscription period. Refund requests must be sent to [email protected].
9.3. No refunds will be issued for Free Tier users as no payment is collected.
10.1. Mockist provides the Platform "as is" and "as available" without warranties of any kind, express or implied.
10.2. Mockist shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of or inability to use the Platform.
10.3. Mockist does not guarantee specific exam results or outcomes from using the Platform.
10.4. Mockist's total liability shall not exceed the amount paid by the User in the 12 months preceding the claim.
11.1. Mockist reserves the right to modify, suspend, or discontinue any part of the Platform at any time with 30 days' notice to registered users.
11.2. In the event of full Platform discontinuation, active Premium subscribers will receive pro-rated refunds for unused subscription periods.
11.3. Free Tier users acknowledge that no compensation is owed upon discontinuation of the free service.
11.4. User data will be retained for 90 days following discontinuation, after which it will be permanently deleted unless otherwise required by law.
12.1. Mockist collects and processes personal data in accordance with applicable data protection laws, including name, email, performance data, and usage analytics.
12.2. User data is used solely for providing and improving Platform services, sending relevant communications, and displaying targeted advertisements to Free Tier users.
12.3. Mockist does not sell personal data to third parties.
13.1. Mockist may terminate or suspend accounts that violate these Terms without prior notice.
13.2. Users may delete their accounts by contacting [email protected]. Account deletion is irreversible.
14.1. These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria.
14.2. Any disputes arising from these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration in Lagos, Nigeria.
Mockist reserves the right to update these Terms at any time. Material changes will be communicated via email or Platform notification. Continued use of the Platform after changes constitutes acceptance of the updated Terms.
